The thesis that technology is applied science is called by Niiniluoto (1997) the standard view. That is surprising because the identification between technology and applied science has been widely rejected by both historians and philosophers of technology, including Rapp (1974), Bugliarello and Doner (1976), Derry and Williams (1977), Feibleman (1983), Skolimowski (1966), Vermaas et al., (2011), Don Idhe (2013). The reasons of such rejection mainly stem from the fact that technology has historically progressed without the benefit of science, i.e., it (...) has been possible to design technological devices without the explicit and systematic development of the scientific theories and laws that would explain their functioning. Polish philosopher Henryk Skolimowski has attacked this identification based on historical evidence. He argues that in the development of technology, there are many cases wherein technological designs have supported pure scientific research, rather than the other way round if technology were applied science. According to Skolimowski, some cases that dispute the identification of technology as applied science are the design of the transistor, supersonic aircraft, and the Manhattan Project. However, this historical evidence should not persuade us for two reasons: 1) Rejecting the previous scientific research that served as the basis for the said technological designs commits Skolimowski to anachronism. 2) From a realistic perspective of science, technological devices are not only subject to the principles and laws of science, regardless of the extent of our knowledge of them, but incorporate insights on more articulated explanations that while not available at the time of designing, do inspire our practical and theoretical efforts and guide further work. In this paper, we posit that the cases offered by Skolimowski to motivate his rejection of the standard view are far from being conclusive. To this end, we not only critically assess each case but also identify other historical examples that might be even more promising to support Skolimowski's thesis. Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga (...) and Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). As touch remains commonly defined by the closeness it physically implies and it rhetorically evokes, the mere notion of distant touch and of distal haptic perception seems peculiar. But Aristotle’s perspective, which I wish to take as a point of departure, is firm: we perceive the objects of touch, the hot and the cold, the hard and the soft, the curved and the sharp, through other things: δι' ἑτέρων. In this article, I would like to explore this ἕτερος by showing (...) how the otherness of perception always implies an intermediary, a middle point (μέσος), i.e. an other not so other, an other that is able to translate the much more distant otherness of the perceived object. To explore these forgotten layers of alterity that fall into what we commonly conceive of as the impalpable emptiness of distance, I propose to study the idea of distant touch from the perspective of phenomenological aesthetics. In order to do so, I will first examine some aspects of the Husserlian account of perception and will then focus on the phenomenology of distant touch in Alejandra Costamagna’s novel El Sistema del Tacto [The System of Touch] (2018). Pulcinella is one of the most ancient comic characters of the Commedia dell’Arte.1 He is the stereotypical lazy servant, insolent and chauvinist, sometimes stupid, sometimes clever, always penniless, and absolutely unable to keep any secret. In a typical Commedia dell’Arte plot, the master reveals a secret to Pulcinella, who is under oath never to disclose it. Needless to say, after swearing that he will never divulge it, Pulcinella soon acts in a very different way, telling the secret to everybody he (...) meets. Yet each time Pulcinella discloses the secret, he asks for total confidentiality, pretending that no one else knows it. Sooner or later all characters on the stage know the secret but none of them know that all the others know it. Eventually each one behaves as though she were the sole repository of the secret while the only secret is that there is no secret at all. I often think of the Pulcinella’s secret nowadays, when someone evokes the ‘medical secret’. (shrink)

We present a preliminary high-level formal theory, grounded on knowledge representation techniques and foundational ontologies, for the uniform and integrated representation of the different kinds of (quali- tative and quantitative) knowledge involved in the designing process. We discuss the conceptual nature of engineering design by individuating and analyzing the involved notions. These notions are then formally charac- terized by extending the DOLCE foundational ontology. Our ultimate purpose is twofold: (i) to contribute to foundational issues of design; and (ii) to support (...) the development of advanced modelling systems for (qualitative and quantitative) representation of design knowledge. I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. Product structures are represented in engineering models by depicting and linking components, features and assemblies. Their understanding requires knowledge of both design and manufacturing practices, and yet further contextual reasoning is needed to read them correctly. Since these representations are essen- tial to the engineering activities, the lack of a clear and explicit semantics of these models hampers the use of information systems for their assessment and exploita- tion. We study this problem by identifying different interpretations of structure rep- resentations, (...) and then discuss the formal properties that a suitable language needs for representing components, features and combinations of these. As Derrida points out, since Aristotle touch has been qualified as ἄδηλον: secret, nocturnal, barely apparent. After some brief etymological remarks, in this article, I explore the mystery that touch represents for language through Levinas’ concept of the secret, thematizing two levels: first, that of the contemporary critique of ocularcentrism, then the level of the tactile experiences that can hardly be (...) put into words. In the last decade, the importance of Simone de Beauvoir’s contribution to 20th-century French philosophy has been beyond debate. However, it can be tempting to read her contributions as the dated beginnings of feminist philosophy, and to believe that her work is only interesting from the perspective of the history of philosophy. To the contrary, this article claims that contemporary philosophers can and should take Beauvoirian philosophy as a source of fruitful insights on contemporary issues in political and moral philosophy (...) by showing the limited scope of two classic critiques of Beauvoir and by defending the relevance of her work for thinking about female submission and the importance of erotic experience. Since the publication of Hartry Field’s influential paper “Tarski’s Theory of Truth” there has been an ongoing discussion about the philosophical import of Tarski’s definition. Most of the arguments have aimed to play down that import, starting with that of Field himself. He interpreted Tarski as trying to provide a physicalistic reduction of semantic concepts like truth, and concluded that Tarski had partially failed. Robert Stalnaker and Scott Soames claimed then that Field should have obtained a stronger conclusion, namely that (...) Tarski’s failure in his allegedly intended physicalistic reduction was total. From another front, Hilary Putnam argued for an even more sweeping thesis: “[a]s a philosophical account of truth, Tarski’s theory fails as badly as it is possible for an account to fail.” Scott Soames followed suit also on this count, endorsing Putnam’s argument in section iii of the aforementioned paper; and John Etchemendy used a very similar argument to contend that “a Tarskian definition of truth [...] cannot possibly illuminate the semantic properties of the object language.” The paper argues that these contentions are based on several misunderstandings about the nature of a definition like Tarski’s. Regarding the Putnam-Soames-Etchemendy argument, we must apply a distinction Frege found natural to draw—and is natural to draw anyway—between what he called “constructive” definitions, definitions properly so called, which are mere stipulations, and what he described as “analytic” definitions, definitions which aim to make explicit the meaning of a term already in use. Regarding the Field-Soames-Stalnaker criticism, the paper contends that the true aims of a Tarskian truth definition are perfectly well fulfilled without Field’s amendments. (shrink)

I discuss an aspect of the relation between accounts of de se thought and the phenomenon of immunity to error through misidentification. I will argue that a deflationary account of the latter—the Simple Account, due to Evans —will not do; a more robust one based on an account of de se thoughts is required. Trope theory is an increasingly prominent contender in contemporary debates about the existence and nature of properties. But it suffers from ambiguity concerning the nature of a trope. Disambiguation reveals two fundamentally different concepts of a trope: modifier tropes and module tropes. These types of tropes are unequally suited for metaphysical work. Modifier tropes have advantages concerning powers, relations, and fundamental determinables, whereas module tropes have advantages concerning perception, causation, character-grounding, and the ontology of substance. Thus, the choice between modifier (...) tropes and module tropes is significant and divides the advantages of trope theory simpliciter. In addition, each resulting trope theory is unstable: modifier trope theory threatens to collapse into realism and module trope theory threatens to collapse into austere nominalism. In a recent paper, Peacocke (2001) continues an ongoing debate with McDowell and others, providing renewed arguments for the view that perceptual experiences and some other mental states have a particular kind of content, nonconceptual content. In this article I want to object to one of the arguments he provides. This is not because I side with McDowell in the ongoing debate about nonconceptual content; on the contrary, given the way I understand it, my views are closer to Peacocke’s, and (...) have been strongly influenced by him. There is a largely unrecognized ambiguity concerning the nature of a trope. Disambiguation throws into relief two fundamentally different conceptions of a trope and provides two ways to understand and develop each metaphysical theory that put tropes to use. In this paper I consider the relative merits that result from differences concerning a trope’s ability to ground the character of ordinary objects. I argue that on each conception of a trope, there are unique implications and challenges concerning character-grounding.

In this paper I explore Michael Loux’s important distinction between “tropes” and “tropers”. First, I argue that the distinction throws into relief an ambiguity and discrepancy in the literature, revealing two fundamentally different versions of trope theory. Second, I argue that the distinction brings into focus unique challenges facing each of the resulting trope theories, thus calling into question an alleged advantage of trope theory—that by uniquely occupying the middle ground between its rivals, trope theory is able to recover and (...) preserve the insights of these views. Ultimately, the distinction suggests that trope theory is a divided house. (shrink)

The truth of a statement depends on the world in two ways: what the statement says is true if the world is as the statement says it is; on the other hand, what the expressions in the statement mean depends on what the world is like (for instance, on what conventions are in place). Each of these two kinds of dependence of truth on the world corresponds to one of the dimensions on the two-dimensional semantic framework, developed in the 1970’ (...) in the work of Evans, Kaplan, Kripke and Stalnaker. In the course of his discussion of perception, Searle criticizes representative theories in general. In this paper I will argue that, even though his criticisms may be adequate regarding a certain form of these theories, perhaps the most frequently defended by philosophers of perception, a version I will outline here scapes to them. A second issue I raise concerns Searle’s claim that his theory of perception is a form of direct realism. I will raise difficulties for Searle’s attempt to maintain (...) at the same time a “token-reflexive” theory of perception and the thesis of direct realism. (shrink)

In this paper I discuss Künne’s Modest Theory of truth, and develop a variation on a worry that Field expresses with respect to Horwich’s related view. The worry is not that deflationary accounts are false, but rather that, because they take propositions as truth-bearers, they are not philosophically interesting. Compatibly with the intuitions of ordinary speakers, we can understand proposition so that the proposals do account for a property that such truth-bearers have. Nevertheless, we saliently apply the truth-concept also to (...) entities such as utterances or assertions , and the de flationary accounts do not provide a similarly deflationary account for those applications. In fact, there are good reasons to suspect that no such account would be forthcoming; we need something more substantive or in flationary there. (shrink)

After a critical examination of several attempts to characterize the Analytic tradition in philosophy, in the book here discussed Hanjo Glock goes on to contend that Analytic Philosophy is “a tradition that is held together both by ties of influence and by a family of partially overlapping features”. Here I question the need to appeal to a “family resemblance” component, arguing instead (in part by drawing on related attempts to characterize art, art genres and art schools) for a genealogical characterization. Nonetheless, I point out that the difference between these two views might end being merely terminological, for, properly understood, a genealogical characterization will have to mention a “family of partially overlapping features” in describing the origins of Analytic Philosophy and the lines of influence among analytic philosophers. This paper discusses the proper taxonomy of the semantics-pragmatics divide. Debates about taxonomy are not always pointless. In interesting cases taxonomic proposals involve theoretical assumptions about the studied field, which might be judged correct or incorrect. Here I want to contrast an approach to the semantics-pragmatics dichotomy, motivated by a broadly Gricean perspective I take to be correct, with a contemporary version of an opposing “Wittgensteinian” view. I will focus mostly on a well-known example: the treatment of referential uses of (...) descriptions and descriptive uses of indexicals. The paper is structured as follows. I will start by characterizing in the first section the version of the Gricean approach I favor; in the second section, I will illustrate the differences between the two views by focussing on the example, and in the third section I will object to what I take to be the main Wittgensteinian consideration. As the subtitle “A Syncretistic Account of Fictional Entities” makes clear, Alberto Voltolini intends in this book to argue for a syncretic view of the ontology and the semantics of fiction. In the process, he offers sympathetic and clear presentations of the main contenders in the field, discussing first ontological matters (chapters 1–4) and then semantic questions (chapters 5–6), and concluding with an ‘ontological’ argument for the allegedly syncretic brand of realism about fictional entities he has by then endorsed. The (...) book will therefore be very useful for all those who want to have a guided overview of the state of the art in the field, and very helpful if used as a main text for an introductory graduate course. There are propositions constituting the content of fictions—sometimes of the utmost importance to understand them—which are not explicitly presented, but must somehow be inferred. This essay deals with what these inferences tell us about the nature of fiction. I will criticize three well-known proposals in the literature: those by David Lewis, Gregory Currie, and Kendall Walton. I advocate a proposal of my own, which I will claim improves on theirs. Most important for my purposes, I will argue on this basis, (...) against Walton’s objections, for an illocutionary-act account of fiction, inspired in part by some of Lewis’s and Currie’s suggestions, but (perhaps paradoxically) above all by Walton’s deservedly influential views. I present a novel position vis-à-vis the views in the Latin American philosophy literature regarding whether subjects more aptly use "Hispanic" or "Latinx" to refer to Hispanic- or-Latinx people. To this end, I will argue (C) the term "Afro-Latinx" is more apt than "Hispanic" or "Latinx" in a significant number of cases. This conclusion is based on three premises. The first premise (P1) is that use of "Afro-Latinx" provides subjects with understanding of how certain events depend on anti-Black racism, US (...) society's racially unjust structure and US colonial policy. The second premise (P2) is that that neither the term "Hispanic" nor the term "Latinx" provide subjects with this understanding of how certain events depend on anti-Black racism, US society's racially unjust structure and US colonial policy. The third premise (P3) is that the term "Afro-Latinx" provides subjects with more understanding of these events than the terms, "Hispanic" and "Latinx.” I present three cases which feature the experiences of Afro-Dominican people. The 1992 murder of Dominican man Kiko García by New York Police officer O’Keefe is first case. The second case is the Washington Heights Uprising that ensued Kiko García’ murder. An instance where a nightclub bouncer in the Dominican Republic denies a Dominican women entry because of her hair texture composes the third case. (shrink)

Singular terms used in fictions for fictional characters raise well-known philosophical issues, explored in depth in the literature. But philosophers typically assume that names already in use to refer to “moderatesized specimens of dry goods” cause no special problem when occurring in fictions, behaving there as they ordinarily do in straightforward assertions. In this paper I continue a debate with Stacie Friend, arguing against this for the exceptionalist view that names of real entities in fictional discourse don’t work there as (...) they do in simple-sentence assertions, but rather as fictional names do. This paper expounds a symbolic interactionist theory of consciousness as an emergent phenomenon. It relates Michael Arbib's theory of the origin of language and Erving Goffman's frame analysis, especially as it bears on our understanding of the subject and of personal experience. Reflexivity and fictional mimesis are shown to be inherent to the origin of language and to the continuing emergent creativity of human communicative action. The emergent aspect of consciousness is also dealt with from the perspective of a narrative (...) theory of subjective experience and of human temporality which can usefully complement and relate Arbib's and Goffman's views. In recent decades, several theories have claimed to explain the teleological causality of organisms as a function of self-organising and self-producing processes. The most widely cited theories of this sort are variations of autopoiesis, originally introduced by Maturana and Varela. More recent modifications of autopoietic theory have focused on system organisation, closure of constraints and autonomy to account for organism teleology. This article argues that the treatment of teleology in autopoiesis and other organisation theories is inconclusive for three reasons: First, (...) non-living self-organising processes like autocatalysis meet the defining features of autopoiesis without being teleological; second, organisational approaches, whether defined in terms of the closure of constraints, self-determination or autonomy, are unable to specify teleological normativity, that is, the individuation of an ultimate beneficiary; third, all self-organised systems produce local order by maximising the throughput of energy and/or material (obeying the maximum entropy production (MEP) principle) and thereby are specifically organised to undermine their own critical boundary conditions. Despite these inadequacies, an alternative approach called teleodynamics accounts for teleology. This theory shows how multiple self-organising processes can be collectively linked so that they counter each other’s MEP principle tendencies to become codependent. Teleodynamics embraces – not ignoring – the difficulties of self-organisation, but reinstates teleology as a radical phase transition distinguishing systems embodying an orientation towards their own beneficial ends from those that lack normative character. Is there any interesting sense in which we can speak of an act as 'evil', in contrast to simply "morally bad' or "immoral"? In ordinary language, we typically judge actions as evil that somehow differ significantly, in terms of degree or intensity, from commonplace wrongdoing. If taken to an extreme, however, this view simply reduces the difference between evil and immoral acts to a mere quantitative analysis. At worst, it leads to a wholly trivial account of evil as just those (...) actions we tend to regard as "really bad". In this paper, I outline a distinctively Kantian theory of evil that instead defends a fundamental qualitative difference between evil and more ordinary immoral actions, locating the main distinction in terms of the structure of the agent's will itself Broadly understood, this strategy endorses a Kantian account of "evil as dehumanization" in which a "material" -- as opposed to purely "formal" -- difference exists between the respective maxims of the immoral and the evil agent. In such instances, unlike typical cases of Kantian immoral actions, direct violation of another person's humanity qua human somehow comprises a necessary part of the "material object" of an evil agent's will. I argue for a substantive interpretation of Carlos Vaz Ferreira’s account of intellectual flourishing as intellectual liberation. For Vaz Ferreira, I argue, there is an inescapable master-slave dynamic between language and language users, so that flourishing intellectually essentially involves a type of mastery of language that frees up thinking from enslaving linguistic/conceptual confusions and thus facilitates the acquisition of truth. Central to this project are Vaz Ferreira’s most interesting, and radical, views on the nature of language signification and thus on (...) human’s ability to accurately describe and know reality, for failing to keep these linguistic limitations in mind, Vaz Ferreira argues, is a central way for language to enslave humans to confused thinking and thus prevent their intellectual flourishing. Schiffer has given an argument against supervaluationist accounts of vagueness, based on reports of vague contents. Suppose that Al tells Bob ‘Ben was there’, pointing to a certain place, and later Bob says, ‘Al said that Ben was there’, pointing in the same direction. According to supervaluationist semantics, Schiffer contends, both Al’s and Bob’s utterances of ‘there’ indeterminately refer to myriad precise regions of space; Al’s utterance is true just in case Ben was in any of those precisely bounded regions (...) of space, and Bob’s is true just in case Al said of each of them that it is where Ben was. However, while the supervaluationist truth-conditions for Al’s utterance might be satisfied, those for Bob’s cannot; for Al didn’t say, of any of those precisely delimited regions of space, that it is where Ben was. In an earlier version of the material presented here (García-Carpintero 2000) I replied to Schiffer’s argument that supervaluationism has an independently well-motivated defense. The response is essentially based on the point that the occurrence of ‘there’ in Bob’s utterance (and of ‘tall’ in Wright’s argument) occurs in indirect discourse, and supervaluationists may allow that it shifts its referent there. Schiffer’s reply to this response shows that it was not made sufficiently clearly. In this paper I will try to improve on that score. In his more recent reply, Schiffer (2000b, 325) dismisses a proposal like the one I will make, mainly because it “undermines … a leading virtue of supervaluationism … its implication that vagueness is … not a feature of the world.” I will argue that my reply does not undermine the fundamental contentions of the supervaluationist account. In this article I propose a new interpretation of David Hume’s position on social contract theory. First, and acknowledging Hume’s critical stance on contractualism, I reject the reasons usually adduced to explain his position: empiricist methodology and utilitarianism. Instead, I argue that to fully understand Hume’s position on contractualism, one must take into account both a psychological methodology and a normative outlook. Second, I highlight Hume’s constructive proposals on the origin and foundation of government and justice, as well as the (...) philosophical approach that he suggested when discussing politics, i.e., mediating between parties. As I argue in this article, these latter aspects of Hume’s political philosophy, often disregarded when examining his reasons against contractualism, are nevertheless essential to understand his views on social contract theory. The claim that knowledge is grounded on a basic, non-inferentially grasped set of principles, which seems to be Aristotle’s view, in contemporary epistemology can be seen as part of a wider foundationalist account. Foundationalists assume that there must be some premise-beliefs at the basis of every felicitous reasoning which cannot be themselves in need of justification and may not be challenged. They provide justification for truths based on these premises, which Aristotle unusually call principles (archái). Can Aristotle be considered a (...) foundationalist? Are his first principles necessary premises to right inferences? We will look at the issue here. (shrink)

I elaborated a bibliographic report for the last issue of "Estudios Nietzsche," which is a monographic issue on Nietzsche and Women. -/- I aimed to select and combine important publications from multiple traditions and schools within Nietzsche scholarship. I hope it becomes a valuable resource to find literature on the topic for both teaching and research purposes.

Several philosophers advance substantive theories of propositions, to deal with several issues they raise in connection with a concern with a long pedigree in philosophy, the problem of the unity of propositions. The qualification ‘substantive’ is meant to contrast with ‘minimal’ or ‘deflationary’ – roughly, views that reject that propositions have a hidden nature, worth investigating. Substantive views appear to create spurious problems by characterizing propositions in ways that make them unfit to perform their theoretical jobs. I will present in (...) this light some critical points against Hanks’ (2015, 2019) act-theoretic view, and Recanati’s (2019) recent elaboration of Hanks’ notion of cancellation. Both Hanks and Recanati, I’ll argue, rely on problematic conceptions of fiction and pretense. (shrink)

Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. Estamos ante una aportación fundamental de la Reforma a la historia del derecho. (shrink)

Cet article montre que Fichte développe une originelle conception du langage dans ses Discours à la Nation allemande d’où il ressort non seulement le besoin de retraduire des concepts philosophiques dans un langage populaire comme aussi celui de formuler un langage plus malléable pour la philosophie en tant que telle. Afin d’explorer cette hypothèse, notre propos suivra les étapes suivantes : (i) nous analyserons la conception fichtéenne du rapport entre popularisation et flexibilisation du langage, ce qui nous permettra (ii) d’explorer (...) les raisons systématiques du rapprochement entre langue philosophique et langue populaire et (iii) de saisir précisément la compréhension du rôle philosophique du langage qui en découle. In this paper, I elicit a number of ways in which, according to the Sartre of The Transcendence of the Ego, we can miss the truth about our own self or, more simply, about ourselves. In order to do that, I consider what I call “statements about one's own self,” that is, statements of the form “I ...” where the predicate of the statement is meant to express things that are true of what is evidently given in reflection. I argue (...) that, although statements about one's own self can, according to Sartre, be true on final philosophical analysis, there are at least three senses in which statements about one's own self can or do miss the truth, even when they are (by hypothesis) true. How they miss the truth depends on the different level of philosophical analysis at which we take Sartre to be working. (shrink)

Gadamer en su conocido Verdad y método y que se pretenda añadir algo nuevo a lo mucho escrito sobre el tema parecería, a primera vista, empresa irrealizable. Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer a (...) primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

Transference theorists propose to explain causation in terms of the transference of a physical element. I argue, in two steps, that this is not possible. First, I show that available accounts of ‘transference’ ultimately convey that transference -and, consequently, causation- is the (non-relational) identity over time of the transferred element (a universal, a trope, or even an absolute substance). But, second, I try to defend, it is conceptually impossible that causation is (non-relational) identity.

Contra recent, inflationary views, the paper submits a deflationary approach to legal ontology. It argues, in particular, that to answer ontological questions about legal entities, we only need conceptual analysis and empirical investigation. In developing this proposal, it follows Amie Thomasson’s ‘easy ontology’ and her strategy for answering whether ordinary objects exist. The purpose of this is to advance a theory that, on the one hand, does not fall prey to sceptical views about legal reality (viz., that ontological truths about (...) legal entities are established by metaphysical principles); and, on the other, is compatible with common-sense jurisprudence (viz., that there in fact exist legal entities, and they all have important practical implications). While this methodology is common to legal philosophers interested in elucidating the ‘artifactual nature’ of law, the paper departs from their projects by taking a step forward in connecting this deflationary approach to legal ontology with an expressivist account of legal discourse, thus providing enough resources to satisfy the general ambition of jurisprudence, viz., to establish the conditions for the analysis of legal reality and its normative character.
